Buyer beware is legal speak meaning there is no returns of auctioned goods; what you buy is what you get. There are different interpretations of the wording depending on which auction house you are dealing with: for example, if you purchase with paypal or from an ebay auction seller, the use of this word would make little difference to a buyer, because the seller would still have to accurately describe the item they were selling.
This is not the case for other auctions houses, such as Centurion Services or Auction Mart, which are two medical equipment auctions. Their policy is "Where is As is," which can be confusing for people who are not familiar with this type of sale.
"The issue is more ethical, than anything else," says an industry expert. "We know ex employee's who have witnessed the owner of Centurion (Erik Tivin) and Auction Mart using Ghost bidding to bid up junk equipment."
Another Medical Equipment buyer Ian Kinnebrew knows Erik Tivin and has purchased at Centurion Services,"You better know going in that this is an auction," says Kinnebrew. "Unless you are there to inspect it, you might as well bid on it like it was junk."
Kinnnebrew noted that, "Erik Tivin is loaded with money...he is the king of used medical equipment purchasing from hospitals. Centurion is his third company."
Tivin was on a plane to india and wasn't available to comment.
But flying on planes seems to be what Tivin does a lot, especially between his chicago location and the one in Las Vegas. If making money is what Tiviin does best, customer service and the general well being of his customers isn't what his company touts.
Kinnebrew admits that buying used medical equipment is a risky bet, "you might as well just roll the dice when you are buying at Centurion."
Medical equipment buyer and refurbisher Monte Mountain has had dealing with Centurion and both owners Eric Wilensky and Erik Tivin, "I purchased nearly twenty thousand dollars worth of equipment there and one item in particular came to me without any internal parts, it was just a shell."

ReplyDeleteThe conversation you and I had has been completely taken out of context! It is unfortunate you feel this is the forum to vent your frustration of the situation you find yourself in. Using my name to validate your lack of knowledge of how auctions operate is unprofessional to say the very least.
As I told you, I could not believe you did not go look at the equipment you were bidding on, as anyone in this industry does prior to purchasing through "auction". The equipment is sold "as is", "where is". If you don't know what that means, then maybe you should not be in this business! Did you read the “terms of sale”?
Yes, I am in the business of buying used medical equipment and yes, it is a roll of the dice when purchasing – that’s the nature of our business. I do my due diligence no matter who I am buying from. To single out Centurion as doing something wrong is a desperate attempt to hold someone else responsible for your obvious inexperience of the auction business.
I have purchased good equipment through Centurion Auction in the past and would do so again in the future. Mr. Tivin knows what he is doing when it comes to running auction houses and has been very successful at it. To find fault with that is only because you did not do your homework. An attempt to slander Mr. Tivin by putting words in my mouth is not only unethical but negligent on your part.

Whatever Ian, These guys are total rip off artists and you know it. I have been staring at crap equipment that was sold by Tivin and Wilensky and group, as good equipment; they hide behind as is where is, but if you tried to sell this crap through paypal or ebay or any other reputable marketing means, you would be out of business. You said what you said, and I reported it.
ReplyDeleteYou and I both know that they are in the business to make money, not be kind to anybody. If you want to suck up to these pond scum maggots, that is your choice, but don't pontificate at how great their business model is. It is a misuse of marketing and you know it.
You and I would both be out of business if we treated customers the way Centurion does.
I know you are friends with these guys and I think your association is fine because you understand that if you buy from them you are most likely going to have to fully rebuild the equipment.
"Be careful," is all I am saying, to anyone who doesn't have experience with auctions and especially shysters like centurion services. It is hard enough to make a living in this business without people like Tiven and Wilensky trying to get one over on you.
I am not mad at you Ian, in fact I feel sorry for you, and the fact that you aren't helping me spread the word that this auction IS FOR EXPERIENCED BIDDERS ONLY WHO CAN REPAIR SALVAGED EQUIPMENT.
Tiven is a crook, his business is to sell junK: fine he should say that. And they should warn people, that hey this is really badly used equipment and most likely it will need a complete re-build.
But instead they market this equipment and sell it at wholesale and above prices when it is only at best salvaged equipment.
The fact that Centurion Auction Services serves a purpose is not in question. The way they sell it is. They should not say in thier fine print: "hey where is as is" They should clearly explain,
"This auction is for experienced medical equipment dealers who have special knowledge repairing salvaged equipment."
If they made this claim I would shut up and go down the road. But as long as they keep marketing great deals and sell them as such; I will keep on writing. I want to warn 1,000,000 potential people;that people like TIVEN and WILENSKY are profiteers looking for a quick buck at the expense of the unsuspecting.
I am hoping the this public decry of outrage will be heard and that people like me would stay far away from people like Tiven and Wilensky.
So Once AGAIN, BUYER BEWARE; Centurion Auction Services sells Salvaged Equipment that most likely needs a complete overhaul; They sell out-of-date, missing parts, and generally worthless equipment for above market rates and they will sell this equipment to any unsuspecting bidders.
This is the disclaimer I am proposing, "Hey look, this stuff may or may not work, you need to bid appropriately; it is salvaged or used equipment, and we DO NOT INSPECT OR WILL NOT WARRANTY OR GUARANTEE THIS EQUIPMENT REGARDLESS IF YOU THINK IT HAS VALUE."
But they don't; they market this stuff and sell it for the highest possible price. Furthermore, I have heard from Monte Montain at Alternative Source, that they drive the price up on online bidders using ghost bidding. People should know this.
